Introduction
These Terms of Service ("Terms") govern your use of the cleaning services provided by FiveBob Hygiene (Pty) Ltd ("FiveBob Hygiene," "we," "us," or "our") in South Africa. By accessing our website, requesting our services, or engaging with us in any manner, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our services or website. These Terms constitute a legally binding agreement between you and FiveBob Hygiene.
Definitions
In these Terms, the following terms shall have the meanings:
- "Business Services" - Commercial cleaning, PPE supply, and industrial hygiene solutions provided to business clients
- "Home Services" - Residential cleaning, deep cleaning, and home hygiene solutions provided to residential clients
- "Client" - Any individual or entity that engages FiveBob Hygiene for services
- "Services" - The cleaning and hygiene services provided by FiveBob Hygiene
- "Site" - The location where services are to be performed
Service Agreement
Service Description
FiveBob Hygiene agrees to provide professional cleaning and hygiene services as specified in the service agreement or quote. Services may include but are not limited to:
- Commercial and industrial cleaning
- Heavy machinery and equipment cleaning
- PPE supply, maintenance, and cleaning
- Residential deep cleaning and maintenance
- Specialized cleaning services
- Custom manufacturing of cleaning products
Service Standards
We commit to providing services with reasonable care and skill, in accordance with industry standards and applicable South African regulations. All services will be performed by trained, vetted professionals using appropriate equipment and eco-friendly products.
Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your service requirements
- Ensure safe access to the service site at the scheduled time
- Secure or remove valuables, fragile items, and personal belongings
- Provide necessary utilities (water, electricity) at the service site
- Inform us of any special requirements, allergies, or safety concerns
- Ensure pets are secured or removed from service areas
- Pay for services as agreed in the service agreement
- Report any issues or concerns within 24 hours of service completion
Pricing and Payment
Service Fees
Service fees are based on the scope of work, property size, and service frequency as outlined in your quote or service agreement. All prices are quoted in South African Rand (ZAR) and are exclusive of Value Added Tax (VAT) unless otherwise specified.
Payment Terms
Payment terms vary by service type:
- Business Services: Payment within 30 days of invoice date
- Home Services: Payment due upon service completion
- Contract Services: As specified in the service agreement
Payment Methods
We accept the following payment methods:
- Electronic Funds Transfer (EFT)
- Credit and debit cards
- Bank deposits
- Cash (for home services only)
Cancellation and Rescheduling
Business Services
For business services, cancellations must be made at least 48 hours before the scheduled service time. Cancellations made less than 48 hours in advance may incur a cancellation fee of up to 50% of the service fee.
Home Services
For home services, cancellations must be made at least 24 hours before the scheduled service time. Cancellations made less than 24 hours in advance may incur a cancellation fee of up to 100% of the service fee.
Rescheduling
Rescheduling requests are subject to availability and must be made within the cancellation notice periods specified above.
Limitation of Liability
To the fullest extent permitted by South African law:
- Our total liability for any claim arising from services provided shall not exceed the value of the specific service performed
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not responsible for damage to pre-existing defects, worn items, or improper maintenance
- Our liability for personal injury or property damage is limited to incidents caused by our negligence
- Client must report any damage within 24 hours of service completion
Insurance and Indemnity
Our Insurance
FiveBob Hygiene maintains comprehensive general liability insurance and worker's compensation coverage as required by South African law. Copies of our insurance certificates are available upon request.
Client Indemnity
You agree to indemnify and hold FiveBob Hygiene harmless from any claims, damages, or losses arising from:
- Your breach of these Terms
- Your negligence or willful misconduct
- Inaccurate information provided to us
- Failure to secure valuables or personal property
Health and Safety
We are committed to maintaining a safe working environment and comply with all applicable South African health and safety regulations, including the Occupational Health and Safety Act. Clients must:
- Inform us of any known hazards at the service site
- Ensure the site is safe for our staff to work
- Provide adequate ventilation for cleaning activities
- Comply with any safety instructions provided by our staff
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of FiveBob Hygiene and protected by South African and international copyright laws. You may not use, reproduce, or distribute our content without our prior written consent.
Privacy
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, natural disasters, or government actions.
Termination
Either party may terminate the service agreement:
- With written notice to the other party
- For material breach of these Terms
- If continuing services would be unsafe or illegal
Upon termination, you shall pay for all services rendered up to the termination date.
Dispute Resolution
Any disputes arising from these Terms or our services shall be resolved as follows:
- First, through good faith negotiations between the parties
- If unresolved, through mediation administered by a mutually agreed mediator
- Finally, through arbitration in accordance with South African law
These Terms shall be governed by and construed in accordance with the laws of South Africa, and you agree to the exclusive jurisdiction of the South African courts.
General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and FiveBob Hygiene
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force
- Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent
- Notices: All notices shall be in writing and delivered to the addresses specified in your service agreement

Effective Date
